Dept. of Natural Reso~~rces <br />On November 16, 1977 the Boulder County Planning Commission reviewed the <br />application submitted by Martin Marietta Cement, Western Division for a <br />mining and reclamation permit for their Lyons Plant located in Boulder <br />County. The County Staff has determined that the proposed operation <br />began before requirements for Special Review were instituted. In regard <br />to the issuance of a permit by the State, the County would like to <br />submit the following comments: <br />1. A portion of the area included within the legal description for the <br /> permit application includes lands zoned Agricultural, which were <br />~ not part of the original ownership rezoned to General Industrial by <br />,~~ Martin Marietta. At the public hearing the Planning Commission <br />, <br />. raised the question of how use of this land relates to permitted <br />~ <br />,.q uses in the Agricultural Zoning District and expansion of the legal <br />~a_ ~'d` non-conforming open mining operation. At this time the County's <br />~~ <br />~ position is that no activities associated with the mining operation <br />~ should occur on these lands, as a 1ega7 non-conforming use has not <br />~+~"' been established. We understand the desire of Martin Marietta to <br />create the most aesthetically pleasing reclaimed landscape possible <br /> and are currently working with the Corporation in resolving this <br /> conflict. Martin Marietta has stated that all operations will be <br /> confined to the GI zoned land until this matter is resolved with <br /> the County. It may be necessary to modify the legal description of <br /> the affected land. <br />2. The County is still considering the extent to which a use such as <br />~~~~ this should be allowed to continue without complying with current <br />zoning requirements. Therefore, the County may require that sometime <br />rnv'" a~ ~~in the future the Martin Marietta Corporation submit an application <br />Ga,r"~~ for Special Use Review to the County. <br />0"~ 3. According to the permit application, the proposed future land use <br />or goal of reclamation is the creation of agricultural, recreational, <br />and residential areas.
