,,.
x
Isadore Million
-2-

March 21, 1995
especially if the stockpile dams the watercourse. A large storm event could
wash all your topsoil away. If this area is the only place available for topsoil
storage I must ask how you intend to prevent the material from being washed
downstream?
3. Exhibit E
c. You did not respond to my question "When will the pit highwalls be graded to
4:1?"
f. You should be reminded, topsoil stockpile sideslopes should be graded to 3:1
or less before seeding. Please commit to grading the sideslopes to 3:1 or less.
4. Exhibit F
a. My topographical interpretation of the fmal pit configuration differs from
yours. It seems to me that the pit area will daylight in the northeast corner
and that the entire 40 acre tract, when mining ceases, will drain to, and
through, the northeast comer, thereby, eliminating the seepage pond. Please
review you interpretation and let me know what you think.
5. Exhibit O
a. Since there has been a change of land ownership on the west side of the
proposed permit area you need to notice Mr. and Mrs. Shaver of your permit
application and send proof to the Division that they were noticed (just like you
did for Appelhanz & Schleich).
6. Exhibit L
a. Since you have changed the mining and rechunation plan (from 1 acre parcels
to 5 acre parcels) the bond requirement will have to be recalculated. The
following criteria will be used to determine the fmancial warranty requirement:
I. There will be one (1) five acre parcel which will be considered major
disturbance. Tasks and equipment required to reclaim the major
disturbance are A) reduce the highwalls around the perimeter of the
parcel from 1:1 to 4:1 with a D-8N Cat, B) rip the pit floor with a
D-8N Cat, C) replace the topsoil with a conventional 621 Cat scraper
and a D-8N Cat, and D) reseed the area with the approved seed mix.
