You adequately answered most of my <br />concerns. In addition, your response raised a couple of questions that need to be addressed. <br />I will list my new concerns using the same format as the initial adequacy letter. <br />1. Exhibit C <br />a. The new Exhibit C map you submitted identifies all the man-made structures <br />within 200 feet of the proposed permit area. Your narrative mentions all but <br />the power pole in the northeast corner of the permit area. You are aware that <br />the power pole belongs to Delta-Montrose Electric Association because you <br />sent them a letter requesting an agreement to repair or replace the pole if <br />damaged by your operation as required by C.R.S. 34-32-115(4)(d). Since the <br />power pole is the only man-made structure within 200 feet of the permit area <br />that you do not own you need to provide a narrative that you will either obtain <br />an agreement from DMF.A to repair or replace the power pole if damaged by <br />your operation or remain 200 feet or more from the structure. <br />b. Now that you have shown where the new access road is located the question I <br />have is will the road remain or will it be reclaimed after mining ceases? This <br />is in reference to the road west of the proposed 40 acre permit area. If the <br />road will be reclaimed it must be part of the permit area. You will have to <br />determine the area of the road and add it to the 40 acres in your permit <br />application. If the road will remain, to provide access to the rest of your land, <br />I will need a statement to that effect. <br />2. Exhibit D <br />a & c. Stockpiling topsoil in a topographical depression may not be a very good idea, <br />
