lyxhibil S~ Permanent Man-Made Structures ~~ <br />/g) While an agreemcnt has been reached with James Stegner, regarding compensation should there he lone term <br />effects from mining on his property, no agreements have been n:ached with the other structure owners. <br />According to C.R.S. 34-32.5-I IS(4)(e), "where such an agreemcnt can not be reached, the applicant shall <br />provide an engineering evaluation that demonstrates that such structure(s) shall not be damaged by activities <br />occurring at the mining operation." An engineering evaluation, :tong with the assumptions that allowed the <br />engineer to reach the conclusion that no damage would be done. must be submitted. Otherwise the Operator <br />must maintain the 200' setback it permission to excavate any cl~tser can not be obtained from the structure <br />owners. <br />The Division received comments from the Division o(Wildlife, stating that they had no problem with [he location of <br />the proposed excavations, but that they recommend that the shorelim: be maximized by using an irregular shaped <br />during final reclamation, and reclaiming the slopes to no steeper than 3H:1 V grade. They also suggested stocking the <br />ponds with fish and constructing an underwater topography/structure: to encourage growth of vegetation and <br />invertebrates, and that all care should be taken to preserve as many lees on the property as possible. <br />The comments from objectors to the application can be summarized as follows: concerns about impacts of mining on <br />groundwater in the area; noise and dust problems; increased traffic along the road; a fear of decrease in property <br />values; and the final reclamation plan, timeframes, and end land-use. These concerns will be addressed at the <br />informal Conference scheduled for May 6, 1999. ~~ <br />Please respond to this adequacy review prior to your current applica~.ion decision due date of June I, 1999, in order <br />for the Division to consider approving this application. Be advised chat this application may be deemed inadequate, <br />and your permit revision may be denied on June I, unless these adec uacy review items are addressed to the <br />satisfaction of the Division.
