i r
a stock water/erosion control pond on the neighbor's property to the north. Nir. Joe P.
Ga~liano of Bamhatt Asency mumioned at the February 24, 1999 hearing regarding this
operation your plans to address this problem. Please include those plans in this exhibit.
5. What distance will be maintained between any mining activity and the property line fence
alon, the north side of the permit area? The depth of extraction is 1 ~ feet, how close to
the fence will this extraction take place? What will the slope of this pit highwall be? The
Division needs this information to detet~nine whether the stability of the structure (within
200 feet of the affected land) will be adversely affected. (See exhibit 6.3.12)
Exhibit D -Reclamation Plan
Your reclamation plan states that the access road might be left. The road appears to serve
no purpose except to access the mining operation. Please include the access road in the
reclamation plan unless you can demonstrate that the landowner has a purpose for the road
upon completion of mining. The pasture appears to be too small to require a road across
it.
2. The reclamation costs you have calculated aze adequate. The financial warranty will be
set accordingly.
Exhibit E - Maos
Your permit application is for a permit area of 9.84 acres which includes a 9.37 acres pit
azea and a 0.47 acre access road. The permit boundaries you show on the mining and
reclamation maps do not include the access road. Please modify these maps to include the
access road in the permit area.
Your Mining Plan states that topsoil will be stripped and stockpiled around the perimeter.
Your mining plan map shows topsoil only stockpiled on the west side of the pit. Either
change the mining map to show topsoil stockpiles around the perimeter or change the
mining plan as necessary. If topsoil is only stockpiled on the west side, reclamation costs
will have to be reviewed. Costs to place topsoil were reviewed on the basis that topsoil
will be placed around the perimeter a stated in the mining plan.
3. The Mining Plan Map shows Floyd Mock as being the surface owner of the land north of
the permit area. While inspecting a permit area on that land I was told that Mr. Mock had
recently sold the land. A phone check with the Elbert County Assessor's Office revealed
that Vemon R. Miller owns the land in question. (N 1 /2 Section 29, T9S, R57W) Please
check this out and if you do Tind that Mr. Miller owns the land change your map
accordingly and notify him immediately of the application.
4. Show the ownerls of the fence along the north side of the permit area and the setbacks you
propose to keep mining operations away from the fence.
C,I~~ossURC~~I9810} AdequacyAoc
