(Buck) Barnhart <br />From: Larry Oehler, Envirortmental Protection Specialist <br />Re: File No. M-98-103 <br />Adequacy Items <br />The following items must be addressed by the applicant in order to satisfy the applicable <br />requirements of C.R.S. 34-32-101 et sea. and the Mineral Rules and Regulations of the Mined <br />Land Reclamation Boazd: <br />Exhibit B -Site Description <br />Rule 6.3.2 requires that permanent man-made structures within 200 feet of the affected <br />area be identified. The owner of the structure must also be identified. Please follow this <br />rule in regazd to the fence along the property line adjacent to the north side of the permit <br />area. <br />Exhibit C - Mininc Plan <br />Your method for protecting topsoil stockpiled for more than one yeaz is to vegetate it by <br />seeding 7 lbs/ac PLS of Western Wheatgrass. The NRCS recommended seeding rate for <br />critical area treatment is l6 lbs/ac PLS for Westem Wheatgrass. Please make this change <br />or demonstrate that 71bs/ac is adequate. <br />2. Your site description mentions a low berm on the west side of the permit area to prevent <br />runoff or siltation of the arroyo. Please include this structure in your mining plan and <br />provide its dimensions and construction specifications. Also show the structure on the <br />mining plan map. <br />3. The bond calculation exhibit D states that backsloping will be done with mining. Provide <br />a statement of commitment, in this exhibit, that the pit margins will be maintained at 3:1 <br />or flatter slopes throughout the mining operation, Or, make appropriate corrections to <br />exhibit D if this is not the case. <br />4. During the December 3. 1998 Division inspection of this site, it was noted that a natural <br />drainage on the west side of the operation was within the northwest comer of the <br />disturbance area and that sediment was being carried off-site by surface flows threatening <br />
