• In accordance with Rule 4, Part 4.05.6(10) of the Rules and Regulations of the Colorado
Mined Land Reclamation Board pursuant to the Colorado Surface Coal Mining
Reclamation Act 34-33-101 et seq., I, Thomas E. Leidich, state that during construction
of Sedimentation Pond 017 inspections were conducted by MWH personal under my
supervision. SCC constructed Pond 017 under the supervision of Mr. Roy Karo,
Reclamation Manager, and Mr. Dan Allen, Surveyox. Mr. Karo and Mr. Allen ensured
that all work was performed in accordance with the design and the specifications.
A MWH employee, under my supervision, inspected the structure on a regular basis to
verify compaction and to make sure that the embankment was being constructed in
accordance with Rule 4, Part 4.05.6(10). My self and/or Jay James (MWH) were also on
the site at several critical occasions during the construction of this pond, as well. MWH
summary of compaction testing for this project is located in Addendum 13-SH-D
The purpose of my inspection and certification was to make sure proper construction of
Sedimentation Pond 017 and to satisfy the requirements of Rule 4.05.6(10) of the
• Colorado Mined Land Reclamation Board. The material was placed in the embankment
to meet or exceed the design specifications (see Addendum 13-5H-E for Geotechnical
Report). This as-built report confirms the construction of this structure meets or exceeds
the Rules and Regulations of the Colorado Mined Land Reclamation Board. The
structure is stable, evidencing no indications of slope instability.
To the best of my knowledge, based upon my professional expertise, and to the extent
possible, Pond 017 at the II-W Mine was constructed in accordance with the prudent
state-of-the-art methods for earthen embankment construction. Further, the suucture
was constructed in compliance with the approved design, to the extent possible, as
specified in Attachment 13-SB, Drainage and Sediment Control Plan, of SCC's approved
mine permit.
r1
LJ
13-5H-3
