Willey; "Olathe Pit" -File No. 84-108
Terra Construction Company; "Olathe Pit" - File No. 83-198
Dear Mr. Willey:
I have received your letter dated November 27, 1984 concerning you 110 permit
application for the Olathe Pit. In general, I feel that you have nswered my
few adequacy concerns. However, I do have a few remaining points f
clarification. I will refer to my original exhibit letter and que tion number
designations for any question areas that need further clarificatio .
As I mentioned, I will need the completed financial warranty (now vidently in
process), and a request from Terra Construction Company to have th it 111
permit on the same site terminated, before the Board can approve y ur 110
permit application for this same site. I presume that I will rece~ve these
items before the scheduled December 13-14, 1984 meeting of the Boa d.
I reviewed your proofs of publication and notifications to adjacen
landowners. The publication is adequate, but I do have one questi n
concerning the notifications. Ed Harrison and the U.S. Government are shown
as adjacent landowners to the north and northeast of the permit ar a,
respectively, I did not receive proofs of notification for these wo
landowners. If they are indeed immediately adjacent landowners, t ey should
be sent a copy of the publication by certified mail, and a copy of the white
or green receipts should be sent to us. If they are not immediate y adjacent
landowners, please let us know.
Exhibit E
1. I am somewhat confused concerning the reclamation plans for the plant
area. As I understand it, the plant area is not to be mined and t us
reclaimed as lake. Instead, this area is to be reclaimed as agric ltural
land. This being the case, topsoil will need to be replaced. If he topsoil
has already been used elsewhere (to the south), how will this area now be
retopsoiled and revegetated?. The topsoil for the plant area must come from
somewhere (either from excess from the mining area or be retrieved from the
hayfield to the south). Please clarify your plans in this matter.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Te (303) 866-3567
