We intend to salvage <br />enough lix b u, 12 inches of reclamation topsoil. The reference to saved dirt on the Mining Plan <br />Map probably should have been in a separate stockpile, which is how it wID he handled in the <br />licld. The imcnt is to indicate that as the mining progresses, mixed fine materials will be sorted <br />out and sux•kpiled liar reclamation. This material will include limestone and shale mixed <br />together. We arc aware of the reyuirements to keep the topsoil in a separate stockpile from <br />material generated during the nutting and intend [o do so. <br />The crossing of the arroyo is necessary to access the quarry. In the pas[, vehicle access has been <br />directly up the arroyo without construction of a road. We agree that a limestone base may be <br />nmre appropriate than the proposed shale. I[ is possible that the native limestone will provide a <br />suitable road hale liir the traffic. If erosion or instability of the road becomes a problem [hen the <br />road section will he upgraded using limestone instead of shale as shown on the Mitring Plan Map. <br />A copy of a slightly revised Mining Plan Map is enclosed. The Army Corps of Engineers has <br />been comactcd end has responded to this project in writing. They have told us a permit is no[ <br />necessary. A copy is enclosed. <br />It is not amicipatetl that we will encounter refuse, acid, or toxic material during this operation. If <br />it happens, then the toxic material will he hauled away and disposed of according to the proper <br />handling rcyuircntents. Material piles will be sited [o minimize exposure to the drainage way. <br />The native material is very alkaline in nature and will not produce acid runoff. <br />Exhihit D -Reclamation Plan: <br />The intern is to provide a minimum of 6 inches of topsoil for reclamation proposes. The 6-12 <br />inches of topsoil referenced in the narrative and the SCS Reclamation Plan is now properly <br />shown on the Reclamation Map. The revised map and Reclamation Plan, Exhibit D, are <br />suhnutted to clarify this issue. <br />The owner of the land, Mr. McKenna has been notified and is amendable to leaving the road and <br />storm water catchments in place. As a matter of fact, Mr. McKenna was given a complete set of <br />the Mining Application on April 9, 2000. <br />Regarding Icnces, there is a cattle crossing located near the intersection of County Road 211 and <br />Highway 10 and County Road 211 and 210. The crossings are part of the McKenna Ranches and <br />the lencc li~llows County Road 210 and the Highway. The land between the crossing and quarry <br />site is open range with no fences along the section of County Road 211 to the quarry site. The <br />statement in the narrative is correct [ha[ [here are no fences along the right of way of County <br />Road 21 I or the boundary of Ernn Liquors and So-Gas. <br />Exhibit E -Reclamation Plan Map: <br />This map has been revised to indicate 6 to 12 inches of topsoil replacement. A copy is enclosed. <br />Exhihit F - Olher Pernuts: <br />The Army Corps o(Engineers has been contacted regarding the possible need for a Corps 404 <br />permit. They sold us we do not need a permit. We are forwarding a letter from the Corps <br />regarding ibis project and their jurisdiction. A copy of the letter is enclosed. <br />
