Letter to Judy xinnick
Page 2
_~
I learned from the US EPA that an Environmental Impact Statement (EIS)
applies only when a federal facility, activity or funding ie involved. Por this
pcojact, request for an 8I5 should be directed to the U.s. Army Corps of
8ngineere (COS) who will evaluate and act on the request for a dredge and fill
permit needed for the abutments that will support the two bridges proposed at the
gravel mining and processing site. Our records indicate that the permit
application for the dredge and fill permit has not yet been filed. If you are
interested in pursuing this avenue, I suggest that you contact Anita Culp at the
COE office in Pueblo. That address and phone number are:
U.S. Army Corps of Engineers
Southern Colorado Project Office
720 North Nain Street, Suite 205
Pueblo, CO 81003-3046
719/543-9459
It ie my understanding that you will need to submit your concerns/request
to the COE in writing, and that you will have a defined timeframe in which to do
this, once the dredge and fill permit application ie filed. Me. Culp can notify
you of the filing date and the timelines for submitting responses. Zn
conjunction with the dredge and fill permit, my agency will undertake an
antidegradation analysis and certify that the quality of the water will or will
not be adversely affected by the proposed operation.
Hy consultations with WQCD hydrogeologiete and with the DxG indicate that
the applicant hoe taken the steps needed to minimi:e the impacts to water quality
from the proposed gravel mining and processing operation. We will continue to
monitor the operation through the discharge monitoring reports that will be filed
on a scheduled basis; the DMG will address water quality considerations in the
reclamation permit that will be issued.
.I am aware that the DNG will conduct a prahearinq conference on the Agile
Stone Systems permit application on xonday, xarch 16th, at 1:00 p.m. at the Canon
City Council Keating Roam located at 612 Royal Gorge Boulevard in Canon City.
This would be a convenient opportunity for you to raise your concerns to the
xined Land Reclamation Saard. I have enclosed a copy of the announcement for the
conference for your reference.
Beyond what I have outlined above, I don't know what else to recommend to
you. If you have further comments or questions, pleaae call me at 303/692-3573.
I would also encourage you to attend the public hearing on the reclamation permit
•chedulad before the xined Land Reclamation Board at 9:00 a.m. on xarch 25 or 26
in Room 318, 1313 Sherman Street in Denver. xe.
