Minnick: <br />Your letter of February 16, 1998 requesting that an Environmental impact <br />Study be ordered for the Agile Stone System gravel pit at Parkdale, Colorado has <br />been referred to me for reeponee. You have indicated that your concern in <br />requesting that the Water Quality Control Division (WQCD) intervene to halt the <br />project is the potential damage that the large volume of water proposed for <br />discharge to the Arkansas River and Tallahassee Creek will create serious impacts <br />to the two waterways. <br />In preparing a response to your letter, Z reviewed the propceal submitted <br />to the Division of Minerals and Geology (DMG) for the gravel mining operation and <br />the gravel mining and processing permit issued by this Division on February 4, <br />1998; met with a representative from DMG to review the project and the water <br />quality impacts; consulted with the US EPA to confirm the criteria and process <br />for ordering an EIS; verified the need for a section 404 dredge and fill permit <br />from the D.S. Army Corps of Engineers, and contacted the Fremont County Planning <br />office regarding the County's position on and statue of the proposed project. <br />I oleo conferred with wQCD hydrologists regarding the potential water quality <br />impacts of the proposed project. <br />The DMG application indicated that there will be a discharge of the volume <br />you indicated to Tallahassee Creek. To ensure protection of the r~[ality of the <br />water and maintenance of the standards in this segment of the Creek, the <br />discharge ie covered by a permit, issued by the Water Quality Control Division, <br />which specifies the limits for total suspended solids (TSS), pH, and oil and <br />grease, the principal conetituente of concern for gravel mining and processing <br />operations. This permit, fCOG-500325, was issued to Agile Stone Systems on <br />February 4, 1998. <br />The WQCD permit addressee the conetituente in the discharge, ensures that <br />the permitted amounts will protect the classified uses of the water, and <br />maintains the standards assigned to the receiving eegment. The classified uses <br />on this segment of Tallahassee Creek are recreation class I, aquatic life class <br />I (cold water), water supply and agriculture. The discharge permit limits <br />included in the permit, which Agile Stone Systems must adhere to, ensure that <br />these uses will be protected. <br />
