applicant must monitor and report results from any discharges as required by its discharge permit. The <br />Applicant's commitments and monitoring plan are sufficient to satisfy Constmction Materials Rule <br />3.1.5(5) and 6.3.3(k). <br />EROSION CONTROL <br />32. Construction Materials Rule 3.1.6(3) requires that all surface areas of affected land shall be stabilized <br />and protected to control erosion. <br />33. The Applicant has committed to applying water to haul roads, and to timely reclamation and vegetative <br />establishment of mined areas as well as stockpiles to control dust. Further, stockpiles must be sloped to <br />minimize erosion. The stockpiles must be located on stable areas, and handling of the soil material must <br />be minimized. <br />34. The Applicant is obligated to use a variety of mulches, surface roughening, and other erosion control <br />practices to ensure the stability of the site and maximize the germination and establishment of the seed <br />that are placed in the reclaimed areas. The Applicant plans to limit the mining disturbance area, <br />contemporaneously establish temporary vegetation covers, roughen soil surfaces, and selectively apply <br />mulches, cover crops and other surface erosion control products. <br />35. The Applicant has demonstrated that its erosion control plan is sufficient to minimize this blowing dust <br />and protect the soil resource, in compliance with Construction Materials Rule 3.1.6(3). <br />36. The Applicant is subject [o fugitive dust emission requirements under its Colorado Air Pollution Control <br />Division permit. This will also ensure effective erosion control. <br />VEGETATION <br />37. Construction Materials Rule 3.1.10 requires that the Applicant plant a vegetative cover that is capable of <br />self-regeneration without continued dependence on irrigation. This rule requires seeding methods that <br />provide the greatest probability of success. <br />38. The Applicant's reclamation plan provides that disturbed areas must be graded to topographically stable <br />slopes. The Applicant must roughen the surface to trap rainwater.
