87. Construction Materials Rule 6.3.5(2) requires, among other things, that the Applicant identify locations <br />of topsoil, subsoil and fill. <br />88. Exhibit E of the application identifies these features, in accordance with Construction Materials Rule <br />6.3.5(2). <br />89. The Applicant must provide a reclamation plan map identifying the postmine topography, vegetation <br />plans, pond configuration, and average replaced overburden and topsoil thickness, in accordance with <br />Construction Materials Rule 6.3.5(3). <br />90. The Applicant has provided a clear description of postmining topography and [he location of the plan[ <br />site on the reclamation plan map in Exhibits D-3 and F-l. The Applicant has identified vegetation detail <br />in Exhibit J and Appendix G. The application includes a detailed description from the initiation of <br />mining to a fully reclaimed parcel. These elements comply with Construction Materials Rule 6.3.5(3). <br />ARCHEOLOGICAL AND HISTORIC PRESERVATION <br />91. Construction Materials Rules 6.3.6 and 6.4.13 require that the Applicant identify other permits, licenses <br />and approvals that it holds or will seek for the proposed operation, including cleazance from the State <br />Historic Preservation Office (SHPO). <br />92. The Applicant conducted a cultural resource investigation by archeological experts and submitted [he <br />report to the SHPO. That Office and the State Archeologist approved the report. The Applicant's <br />cultural resource investigation satisfied the SHPO that the proposed facility would not damage any <br />protected resources. <br />93. This evidence demonstrates compliance with Construction Materials Rules 6.3.6 and 6.4.13. <br />TIMING OF MINING AND RECLAMATION PROCESSES <br />94. Cons[mction Materials Rule 6.4.4(e) requires the Applicant to identify an approximate timetable for the <br />mining operation. <br />95. Construction Materials Rule 6.4.5(2)(e) requires the Applicant to identify a schedule for reclamation in <br />relationship with the schedule for completing different stages of the mining operation. <br />13 <br />
