77. The Division's estimate is based on contemporary costs. However, i[ is reevaluated every four years <br />and is subject to increase, depending on inflation and any other relevant factors. <br />78. The Applicant is not required to bond for the entire mine at one time because the entire permit area will <br />not be disturbed at once. The Applicant has committed to contemporaneous reclamation, It may mine <br />one panel, or portion of the permit area, then commence reclamation on that panel while mining the next <br />panel. <br />79. The Applicant has supplied sufficient information upon which the Division could rely [o accurately <br />estimate reclamation cost. Therefore, the Applicant has satisfied Rule 6.4.12. <br />MAPS <br />80. Topsoil stockpile locations and development contours must be delineated on the mining plan map. <br />Construction Materials Rule 3.1.9(3). <br />81. Exhibit E of the application includes a mine plan map [hat identifies topsoil stockpile locations and <br />development contours. This map complies with Construction Materials Rule 3.1.9(3). <br />82. All application maps must be prepared to a scale that is appropriate to show all elements, but shall not <br />be larger than one inch equals fifty feet nor smaller than one inch equals six hundred sixty feet. <br />Construction Materials Rule 6.2.1(2). The map of affected lands must be prepared to the scale of one <br />inch equals one hundred feet to one inch equals six hundred sixty feet, as specified in C.R.S. § 34-32.5- <br />112(3). <br />83. The Applicant has submitted the appropriate revised application maps drafted on a scale of 1 inch equals <br />600 feet, in compliance with Rule 6.2.1(2) and C.R.S. § 34-32.5-112(3). <br />84. Constmction Materials Rule 6.3.1(2) requires, among other things, that the Applicant name all adjacent <br />surface owners of record. <br />85. Construction Materials Rule 6.4.3(a) also requires that adjoining surface owners of record be identified. <br />86. The Applicant has identified adjacent landowners on separate pages that are keyed numerically to its <br />maps. This satisfies Construction Materials Rule 6,3.1(2) and 6.4.3(a). <br />12 <br />
