<br />EXHIBIT D, Rule 6.3.4 (a): The Exhibit D narrative indicates where the overburden will be stockpiled but <br />not when it will be replaced in relation to ongoing extraction as the Rule requtres. <br />The County should submit a revised Exhibit D which responds to the requvements of this Rule. <br />EXHIBIT D, Rule 6.3.4 (c) (i): The Exhibit D narrative indicates that topsoil ranges in thickness from one <br />to twelve inches at the site but not the thickness of plant ¢rowth medium to be replaced. <br />If the County agrees and commits under Exhibit C to salvage 6 inches of topsoil and subsoil to serve as a <br />plant growth medium at the site, then for the sake of consistency, the County should submit a revised <br />Exhibit D to also indicate this. <br />EXHIBIT D, Rule 6.3.4 (e): The Exhibit D narrative indicates only that the access road, which the <br />Division accepts as not being proposed as part of the permit area, will remain after the mining is <br />concluded. As a result, the Division understands that the "loading area road" illustrated on the map <br />assigned as the Exhibit E-Mine Plan map will be reclaimed after the mining is concluded. The Exhibit D <br />narrative does not, however, indicate what the reclamation treatment will be of the catch pond and the <br />berm (which accompanies the loading area road) at the conclusion of the mining. <br />The Cotmty and submit a revised Exhibit D which indicates what reclamation treatrnent will be given the <br />catch pond and berm. <br />NOTE: THE DIVISION HAS ASSIGNED THE MAPS SUBMITTED AND mENTIFIED BY THE <br />COUNTY AS PART OF EXHIBIT C AND EXHIBIT D TO EXHIBIT E AS THE MINE PLAN AND <br />RECLAMATION PLAN MAPS, RESPECTIVELY. THE COUNTY MUST INDICATE ITS <br />AGREEMENT WITH THESE ASSIGNMENTS OR SUPPLY REPLACEMENT MAPS TO SERVE AS <br />THE EXHIBIT E MINE PLAN AND RECLAMATION PLAN MAPS. FOR THE MOMENT, THE <br />DIVISION WILL CONSIDER THE MAPS ORIGINALLY SUBMITTED BY THE COUNTY AS PART <br />OF EXHIBITS C AND D AS THE MINE PLAN AND RECLAMATION PLAN MAPS AND HAS <br />BASED THE FOLLOWING ADEQUACY COMMENTS ON THEM. <br />EXHIBIT E-MAP, Rule 6.3.5 (1): The map accepted as the Mine Plan Map (see NOTE above) indicates <br />the location of various elements of the mining operation. Some of these elements, however, i.e. part of the <br />loading area road and associated berm, are shown as lying partially outside of the proposed pertnit/affected <br />area boundaries. Both the road and the berm involve mining related disturbance. If this disturbance is <br />extended outside the permit/affected area boundaries, a violation of State Statutes will result. <br />The Counry should submit a revised Exhibit E-Mine Plan Map that indicates the loading area road and <br />berm will be constructed so as to lie within the perrnit/affected azea boundaries. <br />EXHIBIT E-MAP, Rule 6.3.5 (2) (b): The map accepted as the Mine Plan Map does not indicate the <br />names of owner(s) of record of the land within two hundred feet of the permit/affected azea (as it should) <br />or of the fence that also lies within two hundred feet of the petmiUaffected area. <br />The County should submit a revised Exhibit E-Mine Plan map that indicates the land and structure owners <br />as required by this Rule. <br />EXHIBIT E-MAP, Rule 6.3.5 (2) (c): The map accepted as the Mine Plan Map does not indicate the <br />location of the catch pond. <br />The County should submit a revised Exhibit E-Mine Plan Map that shows the location of the catch pond <br />
