~~ ~•• • -27- BIT F (7 of 12) <br />XXL RECORDING <br />21.1 Neither Owner or Lessee shall record a copy of this Gravel Mining Lease in any <br />public rer_ords. <br />2L2 Either Owner or Lessee may request shat a memorandum of this Gravel 1,4ining <br />Lease be recorded in the records of Kiowa County, and such memorandum shall be property <br />executed in front of a notary by both parties, but such memorandum shall contain only the <br />following information: <br />Name and Address of Owner, Name and Address of Lessee, Property description of Leased <br />Premises, and Term of this Gravel Mining Lease. <br />2L3 Should such memorandum of this Gravel 1`4ining Lease be recorded as provided in <br />21.2 above, then Lessee shall, upon request of Owner execute a quit claim decd which shall quit <br />claim to Owner all Lessee's right, title, and interest w this Gravel t`4ining Lease, and such quit <br />claim decd shall be placed with an Escrow Agent suitable to Owner with instructions to the Escrow <br />Agent to file such quit claim decd in the records of Kiow•a County in the event [hat this Grrvcl <br />Mining Lease terminates for any reason. <br />XXII. BINDING UPON SUCCESSORS <br />2:?.l All provisions herein contained shall bind and inure to the bcnc[il of the panics <br />hereto, Ihcir respective heirs, personal representatives, successors or assigns. <br />XXIII. ATTORNEY'S PEGS <br />2a.1. The prevailing party in suit involving the ri;hts, duties and obli~~ations of the parties <br />hereto under [his Gravel Mining Lease shall be entitled in any judgment to recovery oC reasonable <br />attorneys' fees to be fixed by the Court. <br />XXIV. APPLICABLII_AVV. <br />2d.1 This Gravel Mining Lease and any disputes arising thereunder shall be construed <br />aceortline to Colorado Law then in effect. <br />XXV. CONSTRUCTION OP LEASE <br />2`i.l Words of any gender used in this Gravel Mining Lease shall be held to include any <br />other gec.der, and words in the singular number shall be held to include the plural, then the sense <br />requires. Wherever used herein, the words "Owner" and "Lessee" shall be deemed to include the <br />heirs, personal representatives, successors, and assigns of said parties, unless the context excludes <br />such construction. <br />XXVI.
