<br />• -25- ERHIBIT F (5 of 12) <br />12.4 if such default in 12.2 and 123 above is not corrected or correction begun witltitt the <br />time specified, then Owner may terminate this Gravel Mining Lease immediately by written notice <br />to Lessee; and such termination shall be effective immediately upon receipt of such notice of <br />termination by Lessee. <br />12.5 Should this Gravel Mining Lease be terminated under the provisions of this provision, <br />then Lessee shall have the right to remove its mining equipment or buildings from the Leased <br />Premises, except that such buildings, property, or equipment may not be removed from the Leascd <br />Premises should Lessee be in default of any monetary payntcnt to Owner. Lcssce shall have the <br />right to reenter said premises to complete any reclamation or other similar required by any <br />governmental entity. <br />X[Q. NO IMPLIED WAIVERS <br />13.1 The excusing of any duty to be performed under this Gravct Mining Lease shall trot <br />constitute a waiver or excuse to perform any other duty under this Gravel Mining Lease. <br />XIV. CONDEMNATION <br />14,1 If any legal authority institutes a condemnation proceeding Lor any reason, then <br />Owner and Lessee may each challenge such condemnation proceeding indcpendcntly Lur the <br />purpose of protecting their respective interest in the Leased Premises. <br />14.2 Should a condemnation proceeding result in partial liking of the Leased Promises <br />then this Gravel Mining Lease shall continue in full force and effect il; but only il`, the purposes <br />underlyin, this Gravct ;`fining Lcasc can continue to be achieved. <br />XV. CONDUCT OF LESSEE <br />15.1 Other tlu+n is consistent hereunder, Lessee shall not commit waste of the Leased <br />Premises, and all work performed by Lesscc ur his agents shat{ be in a workmanlike fashion <br />according to accepted practices of the industry. <br />XVI. NO OWNER'S WARRANTIES <br />16.1 Owner does not warrant or make any representation as to the nature of any gravel <br />deposits contained on the leased premises. <br />7CVU. COMPLY WITH LAWS <br />17.1 \Vhile conducting mining or milling operations or other ~rork on the Leased Premises, <br />Lessee shall comply with all statutes, talcs, and regulations of the United States Government, the <br />State of Colorado, and the County of Kiowa, or any other authority having jurisdiction over <br />Lessee's v:ork on the Leascd Premises. <br />5 <br />
