Water Quality Contirol Act - 28 <br />Title 25, Article 8 <br />(a) A systsn of user charges to assure that each recipient of services <br />within the municipality's jurisdiction or service area will pay the recipient's <br />prorwrtionate share of the costs of operation, maintenance, and replacement of <br />any sewage treatment works, facilities, or services provided by the municipality; <br />(b) A system of industrial cost recovery to assure that industrial users <br />of the municipality's sewage treatment works pay to the municipality that portion <br />of the cost of construction of the treatment works which is allocable to the treat- <br />ment of such industrial wastes. <br />(2) the municipality is authorized to retain the revenues derived fmn the <br />industrial oust recovery payments made by industrial users of its sewage treatment <br />works and expend such revenues for: <br />(a) Reimbursement of any grants or loans made to the municipality for con- <br />struction of the sewage treatment works; <br />(b) Fl~ture expansion and reconstruction of the seorage treatment works; or <br />(c) Other municipal purposes associated with the sewage treatment works. <br />(3) the municipality shall keep records concerning rates, charges, and <br />amounts collected and how such revenues were allocated. <br />• (4) In the event the federal act permits a system of user charges and a <br />system of industrial cost recovery charges other than that described in subsections <br />(1 ), (2), and (3) of this section, any municipality owning or operating a sewage <br />treatment works is authorized to adopt the system described in the federal act in <br />lieu of the systen described in subsections (1), (2), and (3) of this section. In <br />no case shall a systen be applied pursuant to subsections (1), {2), and (3) of this <br />section and pursuant to subsection (4) of this section concurrently. <br />Price: $1.00 <br /> <br />-28- <br />
