Water Quality Control Act - 18 <br />Title 25, Article 8 <br />(A) Discharges a total volume of more than five million gallons on any one <br />day of the year; <br />(B) Serves a population in excess of ten thousand persons; or <br />(C) Receives caste fran an industrial user and such wastes have a total <br />volume of more than fifty thousand gallons on any day of the year or have a total <br />volume which constitutes more than five percent of the volume of the total dis- <br />charge from the facility on any day of the year. <br />(II) "yfinor municipal discharge" is a discharge from a publicly~wned waste- <br />water treatment plant which is less than all cases in subparagraph (I) of this <br />paragraph (a). <br />(III) 'iNajor industrial discharge" is one in which the discharge from the <br />facility: <br />(A) Has a total volume of more than fifty thousand gallons on any one day <br />of the year from one or more discharge points; or <br />(B) Contains or may contain toxic pollutants. <br />(IV) '?Sinor industrial discharge" is one which does not discharge over <br />fifty thousand gallons in the aggregate on any one day of the year from one or <br />• more discharge points and which does not contain toxic pollutants. <br />(V) "Irrigation return flow" means tailwater, the drainage, or surfaced <br />groundwater flow from irrigated land, in a systen operated by public or private <br />organizations or individuals, if: <br />(A) There is a point source of discharge (e.g., a pipe, a ditch, or any <br />other defined or discrete conveyance), whether an artificial or a natural feature <br />of the land, purposely maintained as a drainage structure; <br />(B) The return flow is fran land areas of more than three thousand con- <br />tiguous irrigated acres or three thousand noncontiguous irrigated acres which use <br />the same artificial drainage system or natural feature of the land purposely <br />maintained as a cumgn drainage structure; <br />(C) The discharge from the lands (as opposed to the water supply to the <br />lands) is controlled by one public or private organization or one individual. <br />Irrigation return flow is concerned with the drainage from irrigated land. It does <br />not include the delivery of irrigation water. <br />(VI) "Feedlots" includes: <br />(A) "9m11 feedlots", by type and capacity: <br />Slaughter and feeder cattle - 1,000 to 4,999 <br />Mature dairy cattle - 700 and over <br />Swine weighing over 55 lbs. - 2,500 to 12,499 <br />- 18 - <br />
