Earl, Melinda Hoffman and Melod9 Reyher ,LESSOR, <br />and CARDt01, INC., a Colorado Corporation, P.O. Box 721, Lamar, CO 81052, <br />LESSEE, <br />In consideration of the sum of $1.00 and other valuable considerations, <br />receipt of which is hereby acknowledged,Ear1, Hoffman and Reyher <br />HEREBY LEASES TO Lessee the tract of land shown below from the date of this <br />Lease until May 1. 1992 at 12:00 Noon for the pur- <br />poses of.' quarrying, mining, removing sad marketing there from alI sand, <br />gravel, rock sad other construction materials. Said land is situate in the <br />County of Bent __, Colorado, and is described as: <br />Section 31 and 32, Township 22 South, Range 48 West <br />Two 10 acre plots approximate location shown on Attachment "A" <br />1. PRICE. Lessee shall pay Earl, Hoffman and Revher monthly <br />on or before the 10th day following each month for gravel and overburden <br />hauled from the premises of the sum of .50 per ton. Lessee shall <br />maintain records of truck loads hauled from the premises, which shall be <br />furnished to Earl. Hoffma~.3eyhar+ and each truck hauling material will be <br />desiga:ited oa Lessee's records. Lessee will Cause test loads for each <br />truck to be wei hted at Earls '~ ie nest, howerver it is not <br />g Hoffman~$pyhPr q , <br />the intention of the parties that each truck load be weighed. <br />2. ACCESS. Lessee shall have the right of ingress and egress to and <br />from the premises on roads presently located on said tract or upon roads <br />constructed by Lessee together with the right to erect temporary struct- <br />ures such as screening and crushing plants, asphalt plants and other st- <br />ruccures necessary to remove and process gravel. <br />'_.. OPTION TO RENEW. Lessee shall have the right sad option to renew <br />this lease for successive periods of -0- Years each. <br />~i. STOCR PILES. Lessee shall retain title to all sand and gravel <br />mined and stock piled on the premises, and Lessee shall have the priv- <br />ilege of stock piling sand and gravel during the term of this option or <br />any extension thereof, whether in vritiag or not, for a period on not to <br />exceed (9) months after Lessee's privilege of mining has terminated.Lessee <br />shall pay at the rate above set forth for stockpiled sand and gravel as the <br />smae are removed. All sand and gravel not removed wihtin the nine-month <br />period shall become the property of the Lessor at the end of said nine-month <br />period. ` <br />5. INDEMNIFICATION. Lessee accepts all responsibilitq for any and <br />all liabilities involved in the crushing and removal of gravel from the <br />premises.
