• RIGHT OF ENTRY AND OPERATION (2.03.6) <br />The lands which would be effected by the proposed refuse pile expansion <br />are controlled by EFCI under a coal mining lease and surface use agreement <br />with Vento et. al. as documented in Section 2.03.4 of the EFCI permit <br />application document. This lease and use agreement give EFCI full right <br />of entry and operation for the subject lands. <br />The entire effected area is also within the permit boundary under EFCI's <br />existing approved mining and reclamation permit (Permit No. C-81-014). <br />ENVIRONMENTAL RESOURCES (2.041 <br />The proposed refuse pile expansion will not result in any additional <br />potential environmental impacts beyond those contemplated in the existing <br />permit application document. In addition, the information on existing <br />• environmental resources presented in the permit application is applicable <br />to the refuse pile expansion area. The following subsections summarize <br />and/or reference relevant information from the existing permit application <br />document. <br />SITE DESCRIPTION AND LAND USE (2.04.31 <br />The area which would be effected by the proposed refuse pile expansion is <br />located on a gradual northeastward facing slope adjacent to the Newlin <br />Creek drainage. This area as well as the surrounding EFCI permit area is <br />characterized by outwash deposits from the adjacent Wet Mountain uplift <br />overlying the basal sedimentary units. The mine area represents a <br />vegetative transition zone between the ponderosa pine/Douglas fir <br />community of the foothills to the west and the shortgrass prairie to the <br />east. <br />Current and historical land uses are similar and include rangeland, <br />• wildlife habitat, and mining. Expanded site description and land use <br />information is presented in Section 2.03.4 of the EFCI permit application <br />document (Volume 1). <br />2 <br />
