As demonstrated <br />in the proposed monitoring plan, the frequency and density of <br />ground water data collection will be adequate to observe and docu- <br />ment trends and fluctuations in the quantity and quality of ground <br />water, and the overall effects of mining on the hydrologic balance. <br />The data collected will be used to minimize disturbances and to <br />plan mitigative measures. <br />(b) Surface water. <br />(1) Surface water monitoring shall be conducted in accordance with the <br />monitoring program submitted under 30 CFR 780.21 (b)(4) and approved by <br />the regulatory authority. The regulatory authority shall determine the <br />~• nature of data, frequency of collection, and reporting requirements. <br />• Monitoring shall-- <br />(i) Be adequate to measure accurately and record water quantity and <br />quality of the discharges from the permit area; <br />(ii) In all cases in which analytical results of the sample collections <br />indicate noncompliance with a permit condition or applicable standard <br />has occurred, shall result in the person who conducts the surface mining <br />activities notifying the regulatory authority within S days. Where a <br />National Pollutant Discharge Elimination System (NPDES) permit effluent <br />limitation noncompliance has occurred, the person who conducts surface <br />mining activies shall forward the analytic results concurFently with the <br />written notice of noncompliance. <br />(iii) Result in quarterly reports to the regulatory authority, to <br />include analytical results from each sample taken during the quarter. <br />Any sample results which indicate a permit violation will be reported <br />• immediately to the regulatory authority.
