Section 816.43(c) Continued. <br />Rule 4.05.3 <br />Revised 12/3/80 <br />Water from certain undisturbed areas will be diverted away from <br />disturbed areas and released from the permit area. For example, <br />ditches I2, I3 and N2 will be used to divert water away from the <br />active mining area and into Williams Draw, as shown on Map 16a, <br />Kerr Mine Area Surface idater Hydrology. <br />The permanent diversion structure at the tipple site will be main- <br />tained and the channel stabilized as described in this section, in <br />order to prevent additional contributions of suspended solids to <br />the Illinois River. <br />(d) No diversion shall be located so as to increase the potential for <br />land slides. No diversion shall be constructed on existing land slides, <br />unless approved by the regulatory authority. <br />No land slide areas exist within the Mine Plan or Tipple Areas. <br />None of the proposed temporary diversions will be located so as to <br />increase the potential for land slides because the slope of the <br />land surface is low and the soil conditions are adequately stable. <br />See Map 35a, Kerr Mine Area Premining Topography, for confirmation <br />of land surface gradients. <br />(e) When no longer needed, each temporary diversion shall be removed <br />and the affected land regraded, topsoiled, and revegetated in accordance <br />with Sections 816.24, 816.25, 81b.101-816.106, and 816.111-816.117. <br />All temporary diversions will be removed and the land reclaimed <br />when no longer required for sediment control as provided in the <br />reclamation plan discussed under Section 780.18.
