No acid mine drainage will occur as the opera- <br />tions move into the Kerr North Area. <br />Existing surface water quality in the Mine Plan Area is affected by <br />grazing activities, existing roads, and previous mining. Surface <br />water upstream from the active mining activities is generally of <br />the calcium-bicarbonate type, is alkaline, and is moderately high <br />in suspended solids. Postmining water quality in the Kerr Mine <br />Area will be equal to that of existing surface water quality, <br />because no acid or toxic discharge will occur and no chemical water <br />treatment should be necessary to meet the effluent limitations <br />listed in 30 CFR 816.42 and NPDES Permit No. CO-0030724 (See Ex- <br />hibit 33, NPDES Permit). <br />n <br />LJ <br />Section 816.43 - Hydrologic balance: Diversions and conveyance of <br />overland flow and shallow ground water flow, and <br />ephemeral streams. <br />Overland flow, including flow through litter, and shallow ground water <br />flow from undisturbed areas, and flow in ephemeral streams, may be di- <br />verted away from disturbed areas by means of temporary or permanent <br />diversions, if required or approved by the regulatory authority as <br />necessary to minimize erosion, to reduce the volume of water to be <br />treated, and to prevent or remove water from contact with acid-forming <br />or toxic-forming materials. The following requirements shall be met for <br />all diversions and for all collection drains that are used to transport <br />water into water-treatment facilities and for all diversions of overland <br />and shallow ground water flow and ephemeral streams-- <br />. (a) Temporary diversions shall be constructed to pass safely the peak <br />runoff from a precipitation event with a 2-year recurrence interval, or <br />a larger event as specified by the regulatory authority. <br />816-37 <br />
