<br /> <br />Section 816.42(aj Continued <br />ity. Additional information relative to the sediment control plan <br />can be found in the discussions in Sections 780.25, 816.45, 816:46, <br />816.47, 816.49 and 816.56. Quality of water and accumulation of <br />sediment in the ponds will be monitored with periodic sampling and <br />with staff gages, as per the schedule described in Section 780.21 and <br />in Table 61, Kerr Mine Area Hydrologic Monitoring Schedule.- The <br />sample locations are shown on Map 16a, Kerr Mine Area Surface Water <br />Hydrology and Map 17a, Kerr Tipple Area Hydrology. <br />b) A discharge from the disturbed areas is not subject to the effluent <br />limitation of this Section, if-- <br />(1) The discharge is demonstrated by the discharger to have resulted from <br />a precipitation event equal to or larger than a 10-year, 24-hour <br />precipitation event; and <br />The discharge is from facilities designed, constructed, and <br />tained in accordance with the requirements of this Part. <br />30 CFR 816.42(b) (1) and (2) have been suspended. In the interim the <br />revised precipitation event exemption of the United States <br />Environmental Protection Agency at 40 CFR 434.22(c), 434.32(b) and <br />434.42(b), as amended, is applicable. <br /> <br />The proposed sedimentation ponds have been designed and will be <br />constructed and maintained to effectively trap sediment from runoff <br />resulting from a 10-year, 24-hour precipitation event as documented <br />in Sections 780.25 and -816.46,--=and -in-__Exhi,bit 42, :Draipage,,,and _- _-•- <br />Sediment Control Plan. <br />816-35R <br />Revised - <br />1991 <br />
