_ Section 186.42(a) Continued. <br />(6) Where the sedimentation pond or series of sedimentation ponds is <br />used so as to result in the mixing of drainage from the disturbed <br />areas with drainage from other areas not disturbed by current coal <br />mining and reclamation operations, the permittee shall achieve the <br />effluent limitations set forth below for all of the mixed drainage <br />when it leaves the permit area. <br />(7) Discharges of water from areas disturbed by surface mining <br />activities shall be made in compliance with all Federal and State laws <br />and regulations, and, at a minimum, the following numerical effluent <br />limitations: (See Table as shown in office of Surface Mining <br />Permanent Regulatory Program, Book 3, Effluent Limitations, in <br />milligrams per liter (mg/lj except for pHj. <br />Sections 30 CFR 816.42 (a)(1) and (7) have been suspended. <br />Nevertheless, Kerr Coal has designed its operations to conform <br />with the foregoing and will alter these designs to the extent <br />practicable if required by future regulations. <br />The plan for protection and control of drainage and sediment, <br />described in Section 780.21, provides that all surface drainage <br />from disturbed land within the permit area will be passed through <br />a sedimentation pond. The sediment control plan utilizes several <br />diversion ditches to either divert undisturbed drainage away from <br />affected areas, or to divert disturbed drainage into <br />sedimentation ponds depending on drainage patterns, topography <br />and limits of disturbance. <br />Exception to the above is the Small Area Exemption (MR-28), <br />located on the west highwall of the Pit 1 Area, shown on Map 16A, <br />Revision 8, Kerr Mine Area Surface Water Hydrology. <br />For example, drainage into Ponds A and B, shown on Map 16A, Kerr <br />Mine Area Surface Water Hydrology, includes runoff from the <br />existing temporary overburden stockpile. Ditches 12, 13 and N2 <br />will be used to divert water from undisturbed areas out of the <br />permit area. All ponds will be constructed, monitored and <br />maintained to meet the standards of CFR 516.46, or other <br />comparable standards which may be adopted by the regulatory <br />author- <br />~-2e 816-34R Revised - January 1996 <br />
