According to C.R.S. 34-32-115(4)(d) A permit shall not be denied except <br />for one or more of the following reasons: <br />The mining operation will adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there is <br />an agreement between the operator and the persons having an interest <br />in the structure that damage to the structure is to be compensated <br />for by the operator. <br />Please provide agreements to satisfy the above statute. <br />6. Will water be used for processing and dust control? Please discuss the <br />above in detail. <br />Exhibit D - Reclamation Plan <br />1. Please explain why reclamation of Phase I cannot occur concurrently with <br />mining of Phase II. Vfhen concurrent reclamation is possible, the <br />Division cannot recommend permit approval unless the operator commits to <br />concurrent reclamation. <br />2. How will the sites be protected from grazing after seeding? <br />3. Will the access roads be reclaimed? <br />4, The Soil Conservation Service (S.C.S.) and the Division recommend final <br />pit slopes of 3H:1V or less. Slopes of 2H:1V are difficult to <br />revegetate unless soil retention devices are used. Please discuss what <br />soil retention methods the operator plans to use on slopes of less than <br />3H :1 V. <br />5. Please provide estimated volumes of topsoil, <br />6. Provide details on the final configuration of the low retention <br /> embankment (Nevius Pit). <br />7. Will the sites be irrigated? If so, please provide details. <br />8.
