The Division of Minerals and Geology (Division) is required to make an <br />approval or denial decision no later than April 12, 1999, therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. If <br />you feel more time is needed to complete your reply, the Division can grant an extension to the <br />decision date. This will be done upon receipt of a written waiver of your right to a decision by <br />April 12, 1999 and request for additional time. This must be received no later than the deadline <br />date. <br />On page 2 of the Application Form, the operator indicated that the mine would be an <br />underground operation. The mine plan clearly depicts the site to be a surface mining <br />operation. Please clarify this discrepancy. <br />As required by Rule 1.6.2 (1)(d), please submit the proof of publication of the public notice <br />circulated in the local newspaper. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />As required by Rule 1.6.2(1)(e), please provide proof of notices to all easement holders that <br />are within 200 feet of the boundary of the affected land and owners of the mineral rights. A <br />cony of the signed, certified mail return receipt card is acceptable. <br />s. Please be advised that you may need a Storntwater Pemtit from the Cuiorado Department of <br />Public Health and Environment, Water Quality Control Division.
