r-~ <br />~~ <br />Please describe how the mining and reclamation operations, specifically [he dewatering <br />operations and the lined pond, will affect the quality and quantity of the wells. <br />The mine plan map shows a set back from the Big Thompson River, but does not specify <br />a set back distance. Please provide the Division with a setback distance and describe how <br />the set back boundary and protected area will be marked and protected from inadvertent <br />disturbance. <br />6. Rule 6.4.9 Exhibit I- Soils Information <br />Please provide the Division with additional information on the lime/limestone material that <br />will be backtilled into the pits. Specifically, please state the distribution, thickness, and any <br />additional soil analysis of the material. <br />7. Rule 6.4.13 Exhibit M- Other Permits and Licenses <br />The applicant may be required to obtain a well permit, augmentation plan and/or substitute <br />water supply plan from the Division of Water Resources, Office of the State Engineer. <br />Please indicate to the Division if these permits will be obtained. <br />8. Rule 6.4.19 Exhibit S- Permanent Man-Made Structures <br />The applicant did not identify any structure within 200 feet of the affected area. Rule <br />1.1(48) defines "Structure. Significant, Valuable and Permanent Man-made" as a non- <br />portable improvement to real property which has defined, current and recognizable value of <br />an economic nature; generally including but not limiting to: buildings, houses, barns, fences, <br />above or below ground utilities, irrigation ditches, maintained or public roads, bridges, <br />railroad tracks, etc. The Boyd Lake Outlet Ditch, utility lines towards the north and fences <br />meet the definition of permanent man-made features within 200 feet of the mine site. <br />Where the mining operation will adversely affect the stability of any significant, valuable or <br />permanent man-made structure located within 200 feet of the affected land, the applicant <br />may either: <br />• Provide a notarized agreement between the Applicant and the Person(s) having an <br />interest in the structure, that the Applicant is to provide compensation for any damage <br />to the structure; or <br />• Where such an agreement can not be reached, the Applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. <br />The applicant will need to submit the notarized agreement or engineering evaluation for all <br />structures located within Z00 feet of the affected area. <br />9. The Division received a letter from [he Department of the Army, Corps of Engineers. A <br />Copy of the letter is enclosed. <br />
