LOns <br />Dnimnn D~reaor <br />Listed below are adequacy review comments on the Waener/Kauffman Pit #3 New 112 <br />Application, Petmit Number M-99-069. The Division of Minerals and Geology (Division) is <br />required to make an approval or denial decision no later than September 13, 1999, therefore, <br />your response to the following adequacy review concerns should be submitted to the Division as <br />soon as possible. <br />As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice <br />circulated in the local newspaper and all owners of record of surface lands, and easement <br />holders that aze within 200 feet of the boundary of the affected land. Proof of notice may be <br />return receipts of a Certified Mailing or by proof of personal service. <br />2. Rule 6.4.3 Exhibit C- Pre-Minine and Minine Plan Map(s) of Affected Lands <br />The scale on the map is 1"=200.' According to this scale, the total permit area is 102.5 <br />acres compazed with the 231 acres noted in the text of the application. Please clarify this <br />discrepancy, and revise the map accordingly. <br />• Rule 6.4.3(8) requires the applicant to show the owner's name of the structure within 200 <br />feet of the affected land. Please indicate the owner of the Boyd Lake Outlet Ditch, <br />owners of the utility line to the northwest and fences surrounding the permit area. <br />3. Rule 6.4.E Exhibit E- Reclamation Plan Please address the following items: <br />• Rule 6.4.5(2)(d) requires the applicant to specify the plan for topsoil segregation. <br />preservation and replacement. Please identify the amount of topsoil to be salvaged, the <br />location of the topsoil piles stored on site, how the piles will be protected from wind or <br />
