routes, and the general effect on the wildlife from increased human activity, <br />including noise. <br />23. The Applicant has conducted a wildlife survey and has evaluated the habitat on the <br />proposed mine site. The land is now used for farming. The Applicant identified no <br />threatened or endangered species. The Applicant's survey provides an adequate <br />description of the wildlife and habitat in the vicinity of the proposed mine site, and is <br />consistent with the wildlife population described by the Objectors. <br />24. There is significant wetlands habitat in an area adjacent to the proposed mine site, in <br />the riparian zone between the South Platte River and the proposed mined site. The <br />Applicant's proposed operation would not disturb this area. <br />25. The Applicant concedes that wildlife would be temporarily displaced and habitat <br />would be destroyed during mining. However, the Applicant argues that its plan to <br />mine in phases and reclaim concurrently minimizes wildlife displacement. <br />26. The Applicant's reclamation plan calls for eight-three acres of water surface. The <br />Applicant plans to plant trees and shrubs around the impoundment. This reclamation <br />plan should improve wildlife habitat over current conditions on the land in question. <br />27. The Applicant's description of wildlife on the property as well as its plans to mitigate <br />impacts to wildlife habitat comply with Construction Materials Rule 6.4.8. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board orders that the <br />application of Hall-Irwin Corporation fora 112c permit, M-2003-001 is hereby approved, <br />with the following condition: <br />
