14. The Applicant has made the necessary commitments to comply with the State <br />Engineer's rules governing injuries to water rights, in accordance with <br />Construction Materials Rule 3.1.6(1). <br />15. If its design does not function as anticipated, the Applicant and the Division <br />will discover the problem by virhze of the Applicant's groundwater <br />monitoring plan. The Applicant has proposed to use five wells to monitor <br />impacts on the aquifer. The Applicant plans to monitor groundwater the wells <br />before installing the slurry wall in order to establish baseline conditions. The <br />Applicant will identify pre-mine conditions as well as conditions throughout <br />all mining phases to detect any changes that might be caused by the slurry <br />wall or any other mining activity. The Applicant proposes to continue <br />monitoring groundwater levels after the wall is constructed in order to identify <br />any fluctuations that might be caused by the wall. <br />16. The Division testified that the groundwater table would not be elevated <br />enough by the proposed slurry wall to flood the surface thereby contaminating <br />the water with surface pollutants such as animal waste, pesticides, herbicides <br />or septic systems. Thus, the Applicant's plan minimizes impact to <br />groundwater quality, in accordance with Constmction Materials Rules <br />3.1.6(1). <br />17. The Objectors presented no evidence or arguments concerning impact on the <br />quality of groundwater in the area. <br />18. The Applicant has designed its proposed slurry wall to minimize effect on the <br />hydrologic balance in the area in question, as well as the quantity and quality <br />
