PERMIT #95-207 SUP - Yoast Mine PAGE 3 <br />c. The dust control plan shall address site specific issues of concern, such as <br />the topsoil stockpiles and wind breaking. The slope of the stockpiles shall be <br />contoured to a slope conducive to vegetative cover. Windbreaking shall <br />occur as necessary by placement of gravel stockpiles or other material in a <br />manner so as to prevent blowing of material from such piles. This condition <br />will apply to stockpiles and any berms which may be developed. <br />13. Weed control shall be exercised on the property as necessary and at least once <br />per year. <br />14. All applicable standards set forth by the Colorado Department of Health and <br />the Routt County Department of Environmental Health shall be complied with. <br />The operation shall comply with all Federal, State and local laws. <br />15. The permittee shall be responsible for any court and attorney fees if Routt <br />County deems it necessary to enforce any of the conditions of the Special Use <br />Permit and is successful in such court action. <br />16. No junk, trash, or inoperative vehicles shall be stored or allowed to remain on the <br />property. <br />17. Fuel, flammable materials, or hazardous materials shall be kept in a safe area as <br />approved by the Chief Building Inspector and Department of Environmental <br />Health. A list of hazardous and flammable materials and their location on site <br />shall be provided to Planning Staff. <br />18. The permittee shall notify the Planning Department staff of the date of <br />commencement of operation to ensure that all conditions of this approval <br />which must be met prior to commencement of activity on the site have been <br />complied with. <br />19. Noise levels, smoke, odors, heat and vibration shall not exceed limits set by <br />Section 8.4 of the Routt County Zoning Resolution. Any smoke or dust emanation <br />from the mine operation shall not exceed Colorado Department of Health <br />Regulations. Emissions permits from the Colorado Department of Health shall be <br />submitted to the Routt County Planning Department prior to commencement of <br />operations. <br />SPECIFIC CONDITIONS /PERFORMANCE STANDARDS: <br />1. The Special Use Permit is valid for 10 years provided it is acted upon within one <br />(1) year of approval. <br />2. A maximum of 100 acres of pit disturbance shall be allowed at any one time. <br />Reclamation shall occur immediately following the completion of mineral <br />extraction in each area. <br />3. Follow requirements of County Road Supervisor and Routt County Engineer <br />regarding use of RCRs 27 and 51 B, and the crossing of the Haul Road on RCR <br />51 D. Any required improvements to the County Roads shall be completed prior <br />to haul truck use of the roads. <br />4. Hauling shall occur along the Haul Road A/B and RCR 27 to the Power Plant or <br />the TAHR. No access for hauling shall be provided from RCR 37. <br />5. Upon completion of reclamation and acceptance of the bond release from the <br />State of Colorado Division of Minerals and Geology, the Seneca II mine will be <br />
