The permittee shall provide evidence of liability insurance, in the amount of no <br />less than $600,000 per occurrence with either unlimited aggregate or a policy <br />endorsement requiring notice to Routt County of all claims made. Routt County <br />shall be named as an additional insured on the policy. <br />2. County roads used for the hauling must be able to accommodate the proposed <br />additional traffic. All haulage roads must have adequate signage at <br />intersections and at any other locations that may require additional signage. All <br />relocated county roads must have adequate dedicated right-of-way and must <br />meet, at a minimum, the Routt County Road Standards. <br />3. All road and bridge repair and maintenance agreements made with Routt <br />County prior to permit issuance shall be adhered to. <br />4. The Special Use Permit is limited to uses and facilities presented in the original <br />project plan. Any additional uses or facilities must be applied for in a new or <br />amended application. <br />5. The Special Use Permit is valid for 10 years and includes all the areas identified in <br />the Operations Plan with the exception of the area located in the southerly 3000 <br />feet of Section 19, lying more than 2000 feet west of the east section line of <br />Section 19, Township 5 North, Range 87 West, provided it is acted upon within <br />one (1) year of approval. <br />6. The operation will be reviewed every five (5) years to ensure that all conditions of <br />the permit are being complied with. <br />7. Any complaints or concerns which may arise from this operation may be cause <br />for review of the Special Use Permit, at any time, and amendment or addition of <br />conditions, or revocation of the permit if necessary. <br />8. Hauling shall take place on County Roads, State or Federal highways when <br />possible when private haul roads are not used. <br />9. Sanitary facilities are to be located on or near the extraction site. <br />10. Routt County has the authority to close any county road at their discretion if <br />such road surtace is in poor condition and would be further damaged by <br />additional use. <br />11. The permittee shall apply for and receive a Colorado Department of Minerals <br />and Geology (DMG) permit and post a reclamation bond with the DMG prior to <br />commencing any operations. The permittee shall be responsible for reclamation <br />as set forth by the Colorado DMG guidelines. <br />12. The Special Use Permit is contingent upon the petitioner complying with the <br />applicable requirements of Regulation III.D of the Colorado Air Quality Control <br />Commission, as a minimum standard, with the following stipulations: <br />a. Periodic inspections by the County shall be permitted to determine <br />compliance with the applicable State Air Quality requirements. The State <br />opacity limit of 20% should be incorporated as a requirement of the permit. <br />Violations of compliance with this standard will be documented by a <br />certified opacity reader. <br />b. The dust control plan can be amended by Planning Commission and the <br />Board of County Commissioners if found to be necessary. <br />
