Mine <br />File No. M-88-042, 517, T2N, R68W of 6th P.M. <br />Dear Ms. Martinek: <br />The purpose of this letter is to advise you of our <br />discu:;sions with Mr. Frank Graham of Western Paving Company <br />regarc9ing their proposed sand and gravel mine which lies <br />immediately south of our property in Weld County. <br />1?or the record Cottonwood Land and Farms, a family <br />partnership associated with the Flatiron companies, exercised <br />it's option to purchase the property north of County Road 20-1/2 <br />and east of Boulder Creek on May 16, 1988. This property has <br />been :Leased and under option by Cottonwood since November 1981. <br />A legal description and map of our property is attached. <br />A:a discussed with Mr. Graham, our main concern is the <br />integrity of the two Smith and Emmons laterals which serve our <br />property from the south. The first lateral lies approximately <br />650 feet east of Boulder Creek and is a concrete lined ditch, at <br />least that portion nearest our property and the County road. <br />This lateral serves approximately 25~ of our property. Mr. <br />Graham has assured us this lateral will remain in operation since <br />it is outside the western limits of the proposed excavation, <br />although some rerouting of the lateral will be required near the <br />main ditch. <br />Ttce second lateral which serves the balance of our property <br />lies approximately 1100 feet east of the first lateral and <br />crosses the County road at the existing access road to the Amoco <br />Oil well (Max Serafini #1). The mining plan as currently <br />propo~;ed would eliminate this lateral entirely. Mr. Graham has <br />assured us that water will be delivered to the same location on <br />our property via a relocated ditch. At this point, some field <br /> <br />
