It is stated on page 4 of the NOI, in the section "Site Development -Exploration Access" that <br />"Primary access to the proposed exploration azea will be via existing Routt County Road 33. As <br />shown on Map 1, unimproved ranch roads and jeep trails will be utilized to access exploration <br />drill-sites within the exploration area." However, Map I does not clearly indicate the locations <br />of these unimproved ranch roads and jeep trails. So that we may be sure that no new roads will <br />need to be constructed for this project, please provide a revised Map 1 that cleazly shows the <br />existing unimproved ranch roads and jeep trails that will be used during this project. <br />Adequacy Review <br />The Division has conducted an adequacy review of the NOI application in accordance with the <br />applicable provisions of the Act and the Regulations. In addition to Item No. 1 above, we have the <br />following adequacy questions: <br />2. Under the "Permittee" section of the NOI application form, both the "Individual's Name" and <br />the "Company Name" were filled in. In accordance with the requirements of regulation <br />2.02.2(2)(a), we prefer that only one of these blanks be filled in. Please therefore submit a , <br />revised NOI application page identifying which entity should be identified as the "Permittee". <br />3. In accordance with the requirements of Regulation 2.02.2(2)(b), please provide the name, <br />address and telephone number of the "representative who will be present at and responsible for <br />conducting the exploration activities". <br />4. The Notice of Intent was submitted by Twentymile Coal Company. The coal lease provided in <br />the NOI is between the State (of Colorado) Boazd of Land Commissioners and Cyprus Western <br />Coal Company. Please provide a copy of the document assigning this lease from Cyprus <br />Western Coal Company to Twentymile Coal Company. This assignment may be on file with the <br />State Board of Land Commissioners. <br />5. It is stated on page 4 of the NOI application, under the section "Site Development -Exploration <br />Access", that "unimproved ranch roads and jeep trails will be utilized to access exploration drill- <br />sites adjacent to existing roads in order to minimize any new disturbance associated with the <br />proposed exploration activities". However, on page 6 of the NOI application, under the section <br />"Exploration Site Reclamation", it is stated in paragraph " 2)" that "any excess drill cuttings will <br />be spread over the drill-pad, and drill-pads, trenched azeas, and any new access road segments <br />graded to approximate their original configuration and blend with the adjacent terrain". If in fact <br />only existing ranch roads and jeep trails will be used for this project, please remove the reference <br />in this paragraph to "new access road segments". <br />6. It is stated on page 4 of the NOI application, under the section "Site Development -Drill-pad <br />Construction", that "Pad construction will begin with removal of existing topsoil material for use <br />in reclaiming the pad". In accordance with the requirements of Regulation 4.21.4(5), please <br />modify this pazagraph to include the following statement: <br />"Prior to earth moving or excavations of any type, the A and B horizons will be <br />
