There are several permits or approvals which are recognized to be required in order for this operation to <br />commence. You have identified several of them in this exhibit, and others have been mentioned in this letter. <br />One which is not on your list is the NPDES permit for surface discharges, from the Water Quality Control Division <br />of CDPHE. Is this one you are inquiring about? <br />44. Please notify me of all other approvals or permits, or imposed limitations, if they have bearing on details of the <br />plans which are being reviewed in this application. <br />Exhibit O -Owners of Record o£Affected Lands (Rule 6.4.15) <br />45. You provided legal descriptions of the Gately property and several easements also owned by Gately, which <br />appazently exist on or near the affected area. These are not descriptions of the permitted area or affected land <br />boundary. Specifically, the descriptions show that the affected area lies within parcel A; parcel B does not pertain <br />to the affected area; and since the locations of parcels C and D are not included, it is not known if they are involved <br />in the affected area. For satisfying this exhibit, please state whether Gately is the only property owner of the <br />affected land, or who the other parties are. <br />46. Please identify and describe all other easements on or within 200-feet of the affected area (such as the gas <br />pipeline easement on the road). <br />Exhibit S -Permanent Man-made Structures (Rule 6.4. ] 9) <br />47. Please provide information identifying the owner of structures and description of the structures, lying on or <br />within 200 feet of the affected area (such as a gas pipeline if one exists in the easement identified in Exhibit O). <br />Please review this rule and provide information showing that there will be no negative impact to the structure or a <br />damage agreement, if applicable. <br />Other Items <br />You have provided proof of placing this application for review with the county clerk and recorder. Please be aware <br />that your written responses and revised maps which will be prepared and submitted to me in response to this letter <br />constitute "additional material" to the application and, as such, must be additionaIiy filed with the clerk and <br />recorder. Please forward to me the receipt(s) for each filing of additional material, prior to the decision date. <br />The decision date is set For March 18, 2002. I am required to state that if, by the close of business on the decision <br />date, your responses do not address these outstanding items, and the application is not adequate for approval, the <br />application may be denied. If you find that additional time is needed to prepare and submit materials, an extension <br />to the decision date may be requested in writing. <br />I will be contacting you in the near future to schedule an onsite inspection. It is my belief that many of these <br />questions could be answered during such an inspection, however, we must endeavor to supply the needed <br />information for the file. <br />Please try to provide your written responses and revised maps with enough time for this office to review them prior <br />to the decision date.
