Please review this rule and add the needed information. <br />32. The imgation ditch formerly separating pits A and C is still shown there, though it is understood that it has <br />been rerouted. Please show it in the proper location for the teclamation stage. <br />33. Certain revisions to the existing map are required. If you have questions, please call before you prepare and <br />submit the revised map. <br />Exhibit G -Water Information (Rule 6.4.7) <br />34. Please provide better description of the settling ponds related to the wash plant. Is the silt pond to be located in <br />area A a separate cell from the rest of the pond in area A? <br />35. Please provide information related to the discharge from dewatering the pits. Will it be directed only to Gately <br />land and ditches, or to properties or conveyances owned by others? Surface discharges to areas outside of the <br />permitted area boundary are considered "offsite." Have you enquired about or obtained the approvals necessary to <br />perform offsite discharges? <br />36. The pond to be created will involve an evaporative surface where there has been hay meadow. Have you or the <br />landowner obtained the necessary approvals from the Colorado Division of Water Resources for the pond? Is there <br />a stated limit of acres of pond surface? If approval is pending, some excavation may occur, but should not extend <br />so deep that groundwater is exposed. Please be aware that if a pond is created, but pond approval is not obtained, <br />backfilling may be required. <br />37. Please describe the depth to groundwater, and any seasonal fluctuation you expect in the water level. <br />38. The ponds aze in the vicinity of several businesses and at least one residence in the industrial pazk. Please state <br />whether there are any wells which could be affected by evaporation or dewatering. <br />Exhibit H -Wildlife Information (Rule 6.4.8) <br />39. You have provided some information, but more clarification appears to be needed. We have received a letter <br />from Rick Basagoitia, the DOW district wildlife manager. He states several concerns related to Gunnison Sage <br />Grouse and Bald Eagle, and others. I have enclosed a copy of his letter for your use. Though the letter was <br />received after the end of the comment period, the comments might be important. Please address these issues, by <br />explaining if they are pertinent to this site, or to other portions of Gately property. <br />Exhibit I -Soils Information (Rule 6.4.91 <br />40. Please provide more specific information about the soils in this area. This maybe obtained from the USDA <br />Natural Resources Conservation Service. This is important to verify that your revegetation plan matches the soil <br />types present, and to determine the area and extent of wetlands on the site. <br />Exhibit J -Vegetation Information (Rule 6.4.10) <br />41. It is understood that much of the site is now in hay (which is not a stand of native vegetation), and that it will <br />not be planted back to hay. However, mention is made of wetland mitigations and an Army Corps 404 permit. <br />Please describe the mitigation, to clarify whether it affects the proposed mining or reclamation plan. <br />Exhibit L -Reclamation Costs (Rule 6.4.12) <br />42. Your responses to many of the questions above will affect the bond estimate for this operation. You have <br />already provided a figure for each acre of reclamation, but no details supporting that figure.
