HydroDynamics, a consulting <br />firm from Denver, was hired to search the records and provide a <br />list of all the adjudicated water rights in the area. As water is <br />sold with the property, it is not always possible to determine who <br />has ownership at the present time. <br />4) a water replacement plan. This must be a legal and physical way <br />of replacing water. One plan CWI would use is to divert Robert <br />Stucker/Overland Uitch water from East Roatcap Creek to West Roat- <br />cap Creek. <br />Matt further discussed the water replacement plan stating that it is <br />unique to each drainage location. Monitoring will be done and repairs made <br />immediately when possible. For example, if there were a pipeline break, it <br />would be quickly repaired. <br />Wally McCaw asked how the water would be affected if it comes from the <br />north of the area being mined. Matt explained that there would be no <br />affect on the surface from the mining when there is an overburden greater <br />than 600 feet above the coal seam. Mr. McCaw then asked if mining might be <br />transferred briefly if there would be a rupture in the pipeline. Matt <br />answered that they would fix the pipeline immediately if that should hap- <br />• pen. <br />Other ways of water replacement could include transportation improve- <br />ments such as concrete lining in ditches, culverts installed, etc., or <br />change in the point of diversion where CWI's water rights would be changed <br />or diverted to another person if there was a loss of water because of min- <br />ing. The change in point of diversion would be filed through the courts. <br />The studies of water adjudicated with the Steven's Gulch drainage <br />indicate that there is 16.533 cfs of irrigation water from the Fire Moun- <br />tain Canal. Other water includes that from fish and stock ponds, domestic <br />water, etc. There is 49.00 cfs being used by CWI which is covered by an <br />agreement for augmentation from Lost Lake Slough. There are eight sources <br />of water located outside the lease boundaries and four lying within the <br />boundary lines. Three of the four are owned by CWI. The eight outside the <br />lease are located on Pitkin Mesa and their source appears to be from seep- <br />age from Fire Mountain Canal. <br />Otto P3vlisick asked if CWI would be allowed to mine under the Pitkin <br />Mes~~ spring. Matt said CWI had looked at the coal to the north but does <br />not plan on mining there. CWI would be more inclined to go up or down the <br />valley; however, Coors who owns the land adjacent to CWI has said there is <br />a fault between the properties and another fault down the valley which <br />would interfere with the mining. <br />• <br />
