Our comments are provided below. These <br />are noted according to the numbering system used in the February 7, 1990 <br />adequacy letter, <br />3. Have you obtained an agreement with CCWCD regarding use of their ditch <br />in connection with your dewatering operations and/or relocation of <br />their wells? If not, please provide additional information regarding <br />your proposed alternative, particularly the size and location of any <br />proposed settling pond(s). <br />4. The response to the question on whether water has been secured to fill <br />the proposed reservoir is based on: <br />(1) The applicant intends to file for junior storage rights for winter <br />diversions when other senior reservoirs cannot divert because of <br />ice blockage of their delivery system, <br />(2) Much transbasin and wastewater effluent is available for the <br />taking, and <br />(3) Recent court filings show gravel pits as proposed reservoirs. <br />It appears that you hold no water rights at this time, and that a <br />filing has not yet been made fora conditional decree. It is the <br />policy of the Mined Land Reclamation Board to require an alternative <br />reclamation plan in the application when no water rights are secured at <br />the time of submittal.
