Rule 6.4.7(3). In addition, please submit a copy of the source of the water rights obtained by <br />Lafarge to supply the project water requirements for the mining operation and reclamation. <br />26. Rule 6.4.7(1) requires the operator to directly state if surface water or groundwater will be <br />affected by the mining operation. The applicant did not locate any wells within 600 feet of <br />the affected land. Lafazge will need to identify all wells of the surrounding area to determine <br />if any maybe impacted by the mining operation. In accordance with Rule 6.4.7(2)(a), please <br />identify all of these wells on the map(s). <br />27. In accordance with Rule 6.4.7(2)(b), the Division requests that the applicant identify and <br />characterize the aquifer to be mined in or through. The Division also requests that the <br />applicant define or predict the cone of depression expected for any areas to be dewatered and <br />dry mined during the life of the operation. The cone of depression assessment should defime, <br />at a minimum, the horizontal and vertical extent of drawdown expected. If during the <br />assessment, the applicant determines that a drawdown will occur offsite that may impact a <br />current groundwater user, the applicant should explain any mitigation measures to be <br />implemented and trigger points that would put mitigation measures into effect. <br />28. In accordance with Rule 3.1.6(1)(a), please explain how disturbance to the hydrologic <br />balance will be minimized during the mining and reclamation phase of the Duckworth Pit. <br />Please explain how Lafazge will be in compliance with Colorado Water Laws and regulations <br />governing injury to existing water rights. Please inform the Division as to when a Temporary <br />Substitute Supply Plan, Well Pernut and Plan of Augmentation will be obtained from the <br />Division of Water Resources. The Division received comments from the Office of the State <br />Engineer (OSE) regarding the application. The letter is enclosed for reference. Please <br />acknowledge the conditions for approval noted by the OSE. <br />29. Please explain how water from dewatering of the Duckworth Pit will be managed to protect <br />against pollution of surface of groundwater both during and after the mining operation (Rule <br />6.4.7(2)(c)). <br />30. Please identify all ditches within 200 feet of the affected land. During the Division's <br />inspection of January 5, 2004 some ditches were noted within 200 feet of the affect land but <br />were not identified on the map. Please locate these ditches on the appropriate maps and <br />further explain the ownership of the ditches. If any ditches are to carry water as a result of <br />the mining operation, please submit a written consent from the owner of the ditch that will <br />allow for the use of the ditch for conveying dewatering flows. <br />31. Lafarge states that the Duckworth Pit is within the 100-year floodplain of Boulder Creek. <br />Please provide the flood elevations(s) to be expected under a "worst case" flooding scenario <br />and specific mitigation measures that will be implemented to minimize the potential for any <br />offsite impacts. Legible copies of the Flood Insurance Rate Maps ("FIRM") through the <br />mine reach would facilitate the Division's review. <br />Rule 6.4.8 Exhibit H- Wildlife Information <br />32. Rule 6.4.8(1)(a) of Wildlife Information requires the Applicant/Operator to include a <br />description of the significant wildlife resources on the affected land. Please specify the <br />significant wildlife resources on the affected land. In developing this information, the <br />Applicant/Operatorrnay wish to contact the local wildlife conservation officer. <br />
