14. The Division received an objection letter from Bernazd Lyons Gaddis & Kahn on behalf of <br />the Smith and Emmons Ditch Company regarding the relocation of the Smith and Emmons <br />Ditch. Included with the objection letter are comments from Tetra Tech RMC. The letter <br />was sent to you under sepazate cover. A number of comments noted by Tetra Tech RMC are <br />legitimate in regard to the relocation of the Smith and Emmons Ditch, and need to be <br />addressed by Lafarge. Please address the following; <br />• Commit to mining-off set distances from the Smith and Emmons Ditch until a notarized <br />agreement can be obtained from the Ditch Company (also see previous comment <br />regarding establishing mining off-set distances until such agreements aze obtained). <br />• Please demonstrate how Lafarge intends avoid restricting the Ditch Company's access to <br />the easement and movement within the easement. <br />• Proved a detailed mining plan and schedule for Phase II of the mining operation. In <br />particulaz, please provide a plan and schedule of how mining will proceed prior to <br />relocation of the ditch, and when that relocation will be accomplished. Lafarge will also <br />need to provide a plan to minimize the impacts to the water rights within the ditch during <br />constrnction/relocation ofthe ditch. <br />Provide detailed construction plans and specifications for the new segment of the ditch. <br />The plans will need to include the locations, elevations, grades and cross-sections of the <br />new ditch, the materials and methods of construction proposed to be used in the <br />relocation of the ditch. All other fixtures relating to the relocation of the Smith and <br />Emmons Ditch must also be designed accordingly (concrete box, utility crossings and <br />pipes). <br />• Demonstrate that the reconstructed ditch can handle the anticipated flow of the Smith and <br />Emmons ditch with adequate freeboazd and demonstrate that the Ditch Company's water <br />rights will be protected in regard to ditch seepage. <br />15. Lafarge states that access and haulage roads required for the proposed operation are already <br />in existence. The maps submitted to the Division do not depict any existing roads on the <br />Duckworth property. Please describe the haul and/or access roads that will be utilized for the <br />mining operation. Rule 6.3.3(8) requires the applicant to specify the dimensions of any <br />existing or proposed roads that will be used for the mining operation. Any improvements <br />necessary on existing roads and the specifications to be used in the construction of the new <br />roads needs to be described in the permit and included as part of the permitted acreage. The <br />applicant will also need to address reclamation of any new or improved roads constructed on <br />site. <br />16. Please specify the depth of the topsoil to be stripped versus the depth of overburden to be <br />stripped. The topsoil will need to be segregated and stored sepazately from the overburden <br />material as required by Rule 3.1.9(1). Please revise the maps to depict the location of the <br />topsoil piles and the overburden piles. In addition, please state the configuration of the piles <br />and how the piles will be protected from wind and water erosion. If vegetative cover is <br />proposed, please include a seed mixture, rate of seeding, method of seeding and weed control <br />measure that will be implemented (please be awaze that topsoil piles in place over one year <br />must be revegetated with a temporary seed mixture). <br />
