TETRATECH RMC <br />Ms. Madoline Wallace <br />January 5, 2004 <br />Page 2 <br />Exhibit E - "The Smith-Emmons ditch is located 200 feet from the western property boundary and will be <br />relocated along the western edge of the property. The mining boundary minimum offset from the western <br />property line is 10 feet. Once the deposit is removed overburden will be compacted for the new ditch <br />according to engineered build (sic) plans taking into consideration water flow rates and allowing for the 70- <br />foot easement." <br />Exhibit F - Includes a label along the western property boundary stating "Smith & Emmons Ditch Relocation", <br />and another label in the vicinity stating "70.0' Easement". <br />Exhibit G - "A portion of the Smith and Emmons ditch will 6e relocated to facilitate mining." <br />Exhibit L - $150,000 of Performance Bond is allocated for Smith & Emmons ditch relocation. . <br />Geoteclmical Stability Exhibit - "Therefore, we recommend that (here be an offset of a minimum of SO feet <br />from waterways, where no mining takes place. From that point, the 3:1 slope discussed above would be <br />applicable." ~ - <br />With such little information to review we can only offer general comments at this time. Approval by <br />the Ditch Company of any zelocation of the Smith & Emmons Ditch can only be recommended after <br />review of detailed plans for the protection, removal, and relocation of the ditch including any <br />appurtenant structures required for the relocation. <br />Lafarge should provide the following for review: <br />1) Detailed mining plan and schedule. A plan and schedule of how mining will proceed <br />prior to relocation of the ditch, and when that relocation is proposed to be accomplished <br />is needed. The ditch must be kept in continual service throughout the irrigation seasons <br />of April through October. Relocation of the ditch may only take place in the non- <br />imgationseason and only with approval of the Ditch Company. <br />2) Detailed construction plans and specifications for the new segment of the ditch. The <br />plans should include the locations, elevations, grades and cross-sections of the new ditch, <br />the materials and methods of construction proposed to be used in the reconstruction. <br />- ' Detailed plans should also be provided for reconstruction of the concrete division box <br />currently located just north of WCR 20%2 so that the water will be duected to the west <br />and precluded from being directed east or north. Detailed plans of all new appurtenant <br />structures are also iequired. <br />3) Detailed plans for any proposed utility crossings of the existing or relocated Ditch. <br />4) Detailed plans for any proposed enclosed pipes to carry the relocated Ditch. <br />
