Canany Division DireROr RE: Lafarge West, Inc., Application No. M-2003-091 Natural Resource Tmstee Duckworth Pit; Adequacy Review Dear Mr. Reckentine, Listed below aze adequacy review comments on the Duckworth Pit New 112 Application, File Number M-2003-091. The Division of Minerals and Geology (Division) is required to make an approval or denial recommendation no later than March 31, 2004, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as possible. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated in the local newspaper, all owners of record of surface lands, easement holders, and owners of record of surface lands that are within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. This includes owners of structures within 200 feet of the affected land (i.e. wells, waterlines, WCR 20 %z, ditches, etc...) Rule 6.4.3 Exhibit C-Pre-Minin¢ and Mining Plan Man(sl of Affected Lands 2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other qualified person. The maps submitted to the Division were not signed. Please resubmit signed copy of the maps. 3. Lafazge identified two adjacent landowners as Cooley Gravel Co. and Western Paving Construction Co. Both of these companies have merged, the first to Aggregate Industries, WCR and the second to Lafarge West, Inc. The maps should be revised to reflect these current landowners. In addition, please assure the Division that Aggregate Industries, WCR did receive notice of the Duckworth Pit Application. 4. Gene Steve Hardison (Parcel # 131316000013) is noted on the "Names of Owners of Property Within 200-feet" on Exhibit C. However, the parcel was not identified on the map portion of Exhibit C. Please revise Exhibit C to include the location of the property owned by Gene Steve Hazdison. 5. Water lines within 200 feet of the affected land were noted on Exhibit S, but were not depicted on the maps. Please identify the location of the water lines and assure the Division Office of Office of Colorado Mined Land Reclamation Active and Inactive Mines Geological Survey
