~~
~~

A Conditional Use Permit (CUP 06-001 Byzantine Quarries) was approved by the Fremont
County Commissioners on May 23, 2006, and issued by Fremont County October 20, 2006,
allowing multiple pits within the affected land. The CUP approved by the Board is included
with this application as Attachment M-1.
~.._. ~ G f u.~I
ie;i;7in9~ and s^~ ~~~
Exhibit M -Other Permits and Licenses
The processing equipment will be permitted by the Air Pollution Control Division (APCD) of the
Colorado Department of Public Health and Environment (the processing equipment proposed to
be used initially has the CDPHE air emissions permit number 04P0129'7). An Application for
Construction Permit and Fugitive Particulate Emissions Control plan from the APCD is pending
and is included with this application as Attachment M-2.
Incumbent rainfall and snowmelt (stormwater) will be directed to a low portion of the current
process area (within the Byzantine Quarries 110 Pit 1: DBMS Permit M2006-020) for retention
and/or percolation into the soils. Storrnwater will not be allowed to leave the affected land.
Sediment from any surface water flow will be retained in the affected land, and no impacts due
to sediment are anticipated. No chemicals will be used in processing, and no impacts to water
quality due to chemicals will occur. No washing of processed material will occur. A Colorado
Department of Public Health and Environment C.P.D.E.S. General Permit certification is not
expected to be necessary, since the site will be graded to retain stormwater runoff on the affected
area.
Cultural resource clearance has been obtained from the Colorado State Historical Office (see
Attachment M-3. No known sites occur within the area).
An access permit from the Colorado Department of Transportation is pending to allow trucks
access to Highway 50 from Fremont County Road 69.
No other permits, licenses, or clearances are required.
