I • Upon final reclamation, Larsen Colorado LLC will demonstrate to the Office that reclamation <br />has been achieved so that existing and reasonably potential future uses of groundwater are <br />protected. <br />(9) Larsen Colorado LLC will provide a written report to the Office within five (5) days should <br />there be evidence that a groundwater dischazge at the Byzantine Quarries 112 Operation exceeds <br />applicable groundwater standards or other applicable permit conditions. <br />(viii) 3.1.8 Wildlife <br />(1) All aspects of the mining and reclamation will take into account the safety and protection of <br />wildlife throughout the yeaz. Adherence to regulations regarding hunting, poaching, harassment, <br />and other regulations of the Colorado Division of Wildlife and other agencies regarding wildlife <br />will be enforced at the Byzantine Quarries 112 Operation. <br />(2) The final land use for the Byzantine Quarries 112 Operation will be rangeland with an <br />emphasis on livestock management. While wildlife may use the reclaimed lands, creating <br />wildlife habitat is not a specific goal of the reclamation plan. <br />(ix} 3.1.9 Topsoiling <br />(1) No overburden will be removed in the operation. No other waste rock materials will be <br />mined. However, available topsoil will be salvaged from areas to be mined shortly before <br />mining commences. If possible, when topsoil is salvaged from any area, that topsoil will be <br />• placed expeditiously on an area to be revegetated, if such area is available at the time of salvage. <br />Should no area be available for revegetation at the time of salvage, salvaged topsoil will be <br />stockpiled and vegetated so that the topsoil is protected from erosion, remains free of any <br />contamination by toxic or acid-forming material, and is in a usable condition for reclamation. <br />(2) A portion of the affected land supports a few pinon/juniper trees. The larger trees will be <br />removed from the azea prior to topsoil salvage. Smaller trees and woody shrubs will be <br />incorporated into the topsoil and used in the revegetation process. <br />(3) Topsoil will be stockpiled and stored as shown on the maps in Exhibit C. These topsoil <br />stockpile azeas are located in areas where the potential for disturbance by mining activities will <br />be minimal. Topsoil stockpiles will be stabilized, vegetated, and protected from erosion. <br />(4) Once stockpiled, topsoil will be rehandled as little as possible. It is anticipated that topsoil <br />will be removed from stockpiles only for use in final reclamation. <br />(5) Larsen Colorado LLC will take whatever measures are necessary to ensure that topsoil placed <br />on areas to be revegetated will remain stable on those areas. These measures include avoiding <br />slippage zones between the topsoil and surface to be revegetated. <br />(6) Larsen Colorado LLC will confer with the Office as necessary to identify other materials on <br />the mine site which may be suitable for growth medium. <br />r ~ <br />LJ <br />
