• Please list all structures that will be constructed on site including their composite, dimensions and <br />method of reclamation. <br />• The applicant states that they are currently investigating the construction costs for the proposed <br />compacted clay liner and will forward this calculation to the Division during the review process. <br />Please submit this information and specify the volume of clay to be excavated for each pond or <br />phased area. <br />• The estimate prepared by the applicant depicts a volume and associated cost to replace 6" of <br />topsoil on the reclaimed areas. However, the permit application states that a minimum of 12" will <br />be redistributed. Please clarify this discrepancy and provide an estimate the volume of topsoil <br />necessary to reclaim each pond and(or phased azea. <br />• Provide an estimated cost to install the interconnect pipelines between the ponds and to the South <br />Platte River. <br />Rule 6.4.13 Exhibit M- Other Permits and Licenses <br />38. The vegetation study prepared by the applicant states that, "...impacts to this wetland may require <br />authorization from the U.S. Army Corps of Engineers pursuant to Section 404 of the clean water act." <br />Please inform the Division if a 404 permit will be obtained prior to disturbance of the wetland azea. <br />Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />39. In the Civil Resources letter it states that, "...the aggregate will likely be transported via conveyor to a <br />processing plant located west of Highway 85 on the existing Lafazge property." The conveyor is not <br />included in the mine plan or exhibits. Please clarify and revise the permit and maps accordingly. <br />40. The Civil Resources report notes a number of borings and piezometers located on the property. Please <br />be aware that the applicant must file for a Notice of Intent to Conduct Explorafion Operations prior to <br />the commencement of such activity. Please see Rule 5 for further detail. <br />41. Please be awaze if the applicant encroaches into any easements as a result of the mining and operation <br />plan, then the applicant must obtain legal right of entry document from the easement holder. Please <br />state what easements will be included, and provide legal right of entry agreements. <br />42. Please inform the Division as to the recorded easement distance for Highway 85, and locate such <br />easement on the exhibits. <br />43. On the Villano property, there is a 50-foot gas line easement running due north of the well There does <br />not appear to be an offset from the temporary 4' high berm and the boundary of the easement. Please <br />clarify. <br />44. The existing well on the Adams property has a 50-foot easement along Highway 85. This easement is <br />not Located on the exhibits and does not appear that there is a buffer from this easement. Please <br />clarify. <br />45. The applicant assumes a 35-foot easement from the Fulton ditch centerline, or 15 feet from the top of <br />the bank, whichever is greater. Please give an accurate easement location, rather than assume 35 feet <br />from the ditch centerline. <br />46. The Division's staff engineer is currently reviewing the stability analysis prepared by Civil Resources, <br />LLC. Any additional questions or comments will be submitted under sepazate cover. <br />
