6. The Division received comments from the NRCS, the Office of the State Engineer, the City of Fort <br />Lupton, Colorado Deparhnent of Transportation (CDOT) and Georgia Landrus regarding the <br />proposed application. The letters are attached. Please address the comments noted in the letters, and <br />make any changes the application as necessary. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan Mans <br />Per Rule 6.4.3(8), the applicant will need to depict the owner's name, type of structure and location of <br />all significant, valuable and permanent man-made structures on the area of affected land and within <br />200 feet of the affected land. Please identify the owners of all structures on and within 200 feet of the <br />affected land. This would include roads, ditches, pipelines, gas lines, gas wells, utility lines, water <br />wells, etc... <br />8. Rule 6.4.3(f) requires that all water wells in the surrounding area be identified on the map. The <br />Division could not locate any water wells on the exhibits. Please locate the wells on a map and state <br />the owners of the wells. <br />9. The permit boundary surrounds the Robert P. & Dean Villano property in the NE corner of the site. <br />Please state if this area is inside or outside of the proposed permit area, and update the exhibits <br />accordingly. <br />Rule 6.4.4 Exhibit D-Mining Plan <br />10. The applicant states that the mining face will be nearly vertical to 0.5:1 slope. However, the exhibits <br />depict the mining slopes to be 1:1. Please clarify this discrepancy and revise the text, stability <br />analysis, and maps accordingly. <br />11. Please state the total azea of land to be affected (in total) compazed with the permitted area of 361 <br />acres. <br />12. Exhibit 3 of 7 depicts two temporary 4' high berms along the perimeter of areas 3 and 6. Please <br />identify if these piles are topsoil or overburden material on the exhibit. <br />13. Hr Exhibit D of the application, the applicant states that overburden will be strigped and stockpiled to <br />the south as mining proceeds from north to south. On map 3 of 7 it is stated that "...topsoil and <br />overburden will be segregatedand-stockpiled around the-perimeter o€ the mining area" and <br />"temporary stockpiles vary in locations and size within each phase." Please depict on the exhibits all <br />topsoil and overburden piles that will be stored on site and used for reclamation. Topsoil will need to <br />be segregated and stored separately from the overburden material as required by Rule 3.1.9(1). <br />14. Please inform the Division as to when topsoil piles will be reseeded to prevent wind and water <br />erosion. In addition, please provide a temporary seed mixture to be used on topsoil and overburden <br />piles. <br />15. The applicant intends to install a conveyor structure over Weld County Road 6.25 and Weld County <br />Road 8. Please provide addifional information regarding the conveyor structure (i.e. composition, <br />length, width, height, foundations, etc.) and a specific plan for reclamation of the conveyor structure. <br />In addition, please provide documentation for the legal right to enter the easement associated with the <br />conveyor structure proposed over Weld County Road 6.25 and 8. <br />16. The applicant states that an asphalt plant and concrete batch plant will be erected on site. Please <br />describe how the facilities will be managed to ensure groundwater and surface water will not be <br />impacted. Please describe the nature and storage location for all hazardous waste that will be used on <br />site. <br />
