Cl?l;~~l~ l)I I:I~~TT ) <br />) J H <br />57ATE OF COLOI~'~I)0) <br />F:L~~~~1 i..j:~i.r }~1.. <br />Si~~:CIAL USE i'Lit;IIT <br />SUI:LA`:D "FINING CORPOi:AT1ON <br />t1ciEREl1S, the Board of County Commissioners of Routt County has duly <br />received a petition foz a Special Ilse Permit from Sunland Mining Corporation <br />fer c~rt~in lands requesting that a Special L'se Permit for expansion of an <br />underground mine and improvement of surface facilities be granted in the <br />Agriculture and Forestry Zone District (AF), and <br />t,'N.EREAS, all necessary data has been submitted and all required fees have <br />been paid on behalf of the petitioner, and <br />kr.EREAS, the petition has been reviewed by the Routt County Regional <br />Planning Commission, which has submitted_an advisory report recommending that <br />the permit be approved subject to the following conditions: <br />1. THAT, the surface landowner-provide a written agreement to the proposal, and <br />_ 2. THAT, the County shall retain its 60 foot right-of-way for road purposes <br />through the area, and - <br />3. THAT, diking be provided along Trout Creek to prevent floodwaters <br />from getting into the coal stockpile area, and <br />k'Hi~tEAS, the Board of County Commissioners has held a public hearing on the <br />a.atter, notice of said hearing having been duly advertised according to law, <br />NOW, THEREFORE, BE IT RESOLVID: <br />1. THAT, the above mentioned Special Use Permit be issued to the Sunland <br />Mining Corporation for the purpose of an underground coal mine and improvement <br />of surface facilities on the following lands: <br />SW~ of Section 22, except the SE'-,Sk''z and the SEI~'k'~ of Section 22, <br />• To;.~nship 4 North, Range 86 West of the'6th P.M., and <br />2. THAT, the petitioner shall provide to Routt County written agreement <br />from the surface landowner authorizing Sunland Mining Corporation to construct <br />Paz aLov~ grounn irlproverenLS proposed, and <br />3. ~_~AT, the County shall retain a 60 foot right-of-way for road purposes <br />through the area of surface i.:,prove'~ents, and <br />4. THAT, did;ing along Trout Creek shall be provided to prevent flood- <br />craters from getting into the coal stockpile, and <br />S. THAT, the elevated conveyor and other overhead facilities crossing the <br />~unt}• F.oad shall be at least 14 feet above [he surface of the road along [he <br />ia~•eled w1y, and <br />:~ ~ <br />6.
