Mine was begun in 1966. The original old bench cut to
expose the seam and develop the portals of the #2 mine was
merely widened and lengthened to accomodate an additional
portal and to facilitate the introduction of more modern
and/or permissible mining equipment to the mine. Soil
material from this re-working of the old cut was used as
fill to expand the originally impacted coal storage and
handling areas which were seasonally flooded by Trout Creek
prior to the rehabilitation of the mine area. This area now
includes a bath-house, coal storage, and preparation and
load-out facilities.
The original impacted area of 2.5 acres was expanded
and elevated to include 5.6 acres. As this expansion (as
well as the historic mining land use) occured prior to the
new state and federal reclamation laws, no topsoil was
stockpiled.
2.04.3 (2)(a)
Sunland Mining Corporation is presently operating the
Apex ~0 2 Mine. Reference is made to map exhibit C, the
subsidence control map, and Plate 1 "Apex #2 Mine Site
Plan" which depict Sunland Mining Corporation's land use at
the time of this permit application.
Description of Land Use Classification under local
law:
Sunland Mining Corporation's permit area is zoned as
Agricultural & Forestry with a Special Use Permit for
Mining under Routt County Planning Commission regulations.
* (from page 12):
The county holds a 60' right of way for road #29
passing through the permit area. There is no recorded
survey of road #29 R.O.W. allignment in the public record.
However, it has been generally accepted by the county to
include 30' on either side of the center line of the
physical location of the road.

~~~5/gam
~.-_ ---~- J-3 _ t
